Public hearing and discussion only regarding Annexation No. A-2016-01 a proposed annexation of territory contiguous to the municipal boundaries of the City of San Luis to include the Gadsden area of southern Yuma County as shown on the petition for annexation recorded at No. 2016-24496 of the Records of Yuma County, Arizona on October 12, 2016.  (Glenn Gimbut, Assistant City Attorney) 

A.  Motion to open public hearing.
     1.  Presentation by staff.
     2.  Call to the public to take all written and/or oral public comments on this item.
B. Motion to close public hearing.

The City of San Luis recorded a petition for annexation of territory, Annexation No. A-2016-01 on October 12, 2016.  A copy of a blank petition together with the legal description and a map is attached to this item.  Notice of this public hearing was advertised in the Yuma Sun.  A mailed notice of public hearing was given to all taxpayers of property taxes within the proposed territory.  A posting was made giving notice at three (3) places within the proposed territory.  By law, a public hearing must be held within thirty (30) days of the recording of the blank petition; this is that hearing.  No action needs be taken after the hearing, and therefore none is proposed.  If council desires that some action be taken Mayor and Council can ask that such an item be placed for consideration on a future agenda.  If the petition is withdrawn, there is a forty-five (45) day waiting period before another can be filed.  Signatures cannot be gathered until November 12, 2016.  The City has one (1) year (until October 12, 2017) to gather sufficient signatures.  Petition must have more than half of the number of property taxpayers and more than half of the assessed valuation within the proposed territory.  Once this is done an ordinance of annexation can be adopted.
