Title:
Adopt Resolution #19-196 Approving Multiple Agreements Related to the Delta ModTech Project
- Right of Entry Agreement
- Stormwater Treatment and Ponding Maintenance Agreement
- Trail Easement
Purpose/Background:
The purpose of this case is to approve several miscellaneous agreements related to the Delta ModTech development project. As referenced at the July 23, 2019 City Council Meeting, there were a few more minor agreements pending as referenced in this case title.
As the Council recalls, approvals have been given for this 220,000 square foot industrial building located near the northeast intersection of Bunker Lake Boulevard and Puma Street. The project is expected to relocate approximately 120 jobs from an adjacent community to Ramsey and create 15 new jobs for the area. A Tax Increment Financing (TIF) Assistance Package has also been granted to the project.

Observations/Alternatives:
Right of Entry Agreement
The Right of Entry Agreement provides the City access to hydrants installed on private property to complete routine maintenance and flushing. The watermains onsite will remain private. This is a standard agreement utilized in this circumstance.
Stormwater Treatment and Ponding Maintenance Agreement
The onsite stormwater ponds will be private and maintained by the Owner. Since the ponds will not be maintained by the City, the City needs to ensure that ponds continue to function as designed. This agreement holds the Owner accountable for necessary stormwater pond maintenance.
Trail Easement
As part of the approval process, the Owner has agreed to convey the necessary trail easement needed for the future Lake Itasca Greenway. This is the legal instrument to convey said easement. The exact legal description is still being developed, and will be inserted into the final version.

Funding Source:
All costs associated with processing these agreements are the responsibility of the Applicant. A Tax Increment Financing (TIF) Assistance Package has also been granted to the project by the City of Ramsey.
Recommendation:
Staff recommends approval of these agreements.
Action:
Motion to adopt Resolution #19-196 approving Right of Entry Agreement, Stormwater Treatment and Ponding Maintenance Agreement, and Trail Easement.
