Title

Adopt Resolution #19-240 Approving Development Agreement for Suite Living (Project #19-121); Case of Hampton Companies

Purpose/Background:

The purpose of this case is to consider the proposed development agreement between the City and Hampton Companies, Inc for the purposes of a 23 unit senior living facility.  The City previously approved the site plan for the project (Resolution #19-154) on July 23, 2019.  A condition of approval for the site plan was entering into a future development agreement with the City.

Notification:

No additional notification is required for the consideration of the proposed development agreement.  The development project itself has been reviewed by both the Planning Commission and City Council with appropriate public notice issued with that review.

Observations/Alternatives:

The proposed development agreement is the City's standard form and the development agreement itself is the next step in the development process towards actual construction of the project. City Council should note that development fees for the property have been previously paid by Paxmar LLC via their development agreement (Resolution #19-151) with the City when they previously platted the lot.  The fees paid were based on the proposed Suite Living project. The proposed development agreement recognizes that those fees were previously collected. The City will still require the standard financial surety, inspection fee, warranty, and landscaping maintenance warranty based on the reviewed engineers estimate.


Alternatives

Alternative 1: Adopt Resolution #19-240 approving the development agreement for Suite Living. The proposed development agreement is the City's standard form and the Applicant has not opposed of any language. Staff supports Alternative 1.

Alternative 2: Do not adopt Resolution #19-240 approving the development agreement for Suite Living. The development agreement is the next step in the development process and necessary prior to the project beginning construction.  Staff does not support this alternative.

Costs associated with this request are the responsibility of the Applicant.

Recommendation:

Staff recommends adoption of Resolution #19-240 approving a development agreement for Suite Living (Project #19-12); Case of Hampton Companies.

Action:

Motion to adopt Resolution #19-240 Approving Development Agreement for Suite Living.
