Purpose/Background:

Purchase of case is to approve the metes and bounds legal description for the sale of city-owned land to Ramsey Hotel Group LLC
Background:
The City approved the sale of City owned land to Ramsey Hotel Group LLC prior to the approval of final plat and site plan. This case formalizes the approval of the metes an bounds subdivision, legal descriptions and the Sales Resolution that is required for the recording of the Torrens documents of transfer and other associated documents.

Background:
The City approved the sale of City owned land to Ramsey Hotel Group LLC prior to the approval of final plat and site plan. This case formalizes the approval of the metes an bounds subdivision, legal descriptions and the Sales Resolution that is required for the recording of the Torrens documents of transfer and other associated documents.
Notification:
Notification is not required.
Observations/Alternatives:
All necessary approvals for the sales transaction have already been approved. This case is needed in order to split the parcel to sell only that area needed for Cobblestone Hotel. The project must still go through the traditional Plat Approval and Site Plan Review as required with all new development projects.
Alternatives
Alternative #1 - Approve the lot split and sales resolution. While this is not the standard process for splitting parcels and the City generally does not allow a split via metes and bounds description, the City Council has previously directed an early closing of this parcel. The Applicant will need to obtain Final Plat Approval prior to any construction.
Alternative #2 - Wait until a Final Plat can be approved in order to convey a traditional legal description to the Buyer. This process could take up to 45 days. Normally, Staff would recommend this process as required by City Code. However, given the unique circumstances of the existing Emergency Declaration, Staff would support this as a one-time exception.
