Title

Adopt Resolution #20-251 Approving Abatement of 8049 146th Ave NW

Purpose/Background:

The purpose of this case is to approve an abatement for nuisance items at 8049 146th Ave NW (the "Subject Property"). The Subject Property has an open code enforcement case for nuisance items (a large brush pile, tires and pallets onsite, and construction material and junk stacked onsite) as well as off-street parking regulations for vehicles and equipment parked on the grass. This case is to request removal (abatement) of just the nuisance items. Staff is attempting to work with the Property Owner and tenant, and has been working with them for over a month, to bring forward a resolution related to the lawful, non-conforming use of the property. This type of resolution takes research of historical photos and records, and Staff hopes to bring this forward by the end of November 2020.

Notification:

No notification is required. Staff notified the Property Owner and tenant of case via email.

Observations/Alternatives:

The Subject Property has received a compliant related to the outdoor storage, parking, and junk items on the Subject Property. At this time, Staff is recommending that the City remove the junk items onsite and anything related to the nuisance chapter (Chapter 30). Staff is not recommending removing vehicles, storage containers, or equipment onsite. Garbage, piles of tires, a large brush and debris pile, and construction materials stacked outside will be removed.

The first notice of violation was sent on August 11, 2020. Staff has not seen any progress onsite since the first notice was sent. Staff is happy to work through the logistics of lawful, non-conforming protections along with any request to allow an expansion to said protection. However, the Property Owner needs to propose a solution and apply for the appropriate special use permit to be reviewed by the Planning Commission and City Council. If the Property Owner does apply for the appropriate permit, the abatement (except items covered by nuisance provisions, e.g. garbage, tires, etc.) would be paused to allow due process on that Application. 

Funding Source:

Staff handles Code Enforcement as part of their regular duties.

Recommendation:

Staff recommends that the City Council adopt Resolution #20-251.

Action:

Motion to adopt Resolution #20-251 approving abatement of 8049 146th Ave NW.
