Title
Adopt Resolution #21-102 Approving Code Enforcement Action Plan for 5393 141st Ave NW (Case of Bryan Maki)
Purpose/Background:
Staff is seeking authorization to hire a siding contractor to repair the rear of the home at the expense of the property owner. The City will front the costs of the abatement and assess the costs back to the Property.
Notification:
No notification is required.
Observations/Alternatives:
City Staff was first notified of siding issues at 5393 141st Ave NW in October 2020. Following through the code enforcement process, City Staff made contact with the property owner to repair the damage to the home. Each time a status request has been relayed to the property owner, they have stated that no plans have been made and the violation is approaching six (6) months without resolution.
Building Official, Jesse Szykulski, and Planning Technician, Brian McCann, inspected the bump-out, and the interior of the home on March 12, 2021. While the bump-out has significant damage, the interior of the home appears to remain intact. Additional damage appears to have occurred where the deck is attached to the home. Photos of the inspection are included with the case.
A timeline of the case is below:

A timeline of the case is below:
- Complaint was received about the property on October 28, 2020 regarding damage to the rear of the home.
- A drive-by inspection was conducted on November 2, 2020 which confirmed the damage to the home.
- A formal letter was sent to the property on November 4, 2020 requesting plans for repairs be submitted by December 3, 2021.
- The property owner called on November 25, 2020 to discuss the letter and what is required of him. Staff notified him that construction plans need to be submitted by December 3, 2020 to provide incentive that repairs are being planned.
- A phone call occurred on December 16, 2020 with the property owner stating they have not made plans to repair the siding given the season of the year, and insufficient funds to do the repairs. Staff requested the owner to keep the City updated with any repair plans.
- On February 17, 2021, an additional complaint was submitted regarding the status of the home.
- On February 19, 2021, City Staff discussed the situation with the City Attorney to determine next steps.
- City Staff requested an inspection of the property on March 12, 2021 to inspect the interior of the home.
- The inspection occurred on March 12, 2021 which revealed additional damage to the home due to a missing eave on the rear, woodpecker issues, and improper construction of the deck. City Staff requested plans be made within two weeks, or the City will escalate.
- City Staff contacted the property owner on April 2, 2021 asking if any plans had been made. The property owner became frustrated and stated they had not hired a contractor.
Funding Source:
Staff handles all Code Enforcement cases as part of their regular duties.
Recommendation:
Staff recommends Adopting Resolution #21-102 Approving Code Enforcement Action Plan for 5393 141st Ave NW to repair the rear of the home.
