Title
Adopt Resolution #21-181 Approving Maintenance Agreement and Development Agreement for O'Reilly Auto Parts, Case of Java Properties
Purpose/Background:
The purpose of this case is to approve a maintenance agreement for an architectural wall and the development agreement for O'Reilly Auto Parts, being proposed by Java Properties, LLC (the "Applicant").
Notification:
No notification is required for this step.
Observations/Alternatives:
The approval of the standard development agreement is a typical step in the development process, which outlines development fees and takes a financial surety for the work onsite to ensure that it is completed to City standards. The maintenance agreement for the architectural wall is not a typical step, but has been required for other projects, most recently, River Walk Village. The Council directed Staff to prepare a maintenance agreement for the architectural wall, since it is a first for the City and different from the standard process. Both agreements are subject to City Attorney review.
Funding Source:
The Applicant is responsible for all costs associated with project review and approvals.
Recommendation:
Staff recommends the City Council adopt Resolution #21-181
Action:
Motion to adopt Resolution #21-181 approving the maintenance agreement and Development Agreement for O'Reilly Auto Parts.
