Title

Adopt Resolution #21-214 Approving the Abatement of a Fence at 8405 167th Lane NW. 

Purpose/Background:

Planning is seeking authorization to abate a fence placed through a City owned Easement and into a neighboring property. The Property Owner installed the fence without a permit in 2020. A code enforcement case was opened after receiving a complaint in Juy 2020. The Property Owner applied for a fencing permit with a site plan that showed the fence being placed a foot from the Easement, on their own property. The Property Owner was given 6 months from the issuance of the fence permit, October 2020, to move the fence entirely on his property according to the site plan. The Property Owner has not moved the fence from the Easement or the neighboring property. 

Notification:

No notification is required. 

Observations/Alternatives:

The Property Owner is allowed to have a fence in accordance with City Code Section 117-111 R-1 Residential District. The fence was not placed in compliance with City Code Section 117-111; the fence was not accurately placed in the Subject Property boundaries. The fence on the Subject Property has been in place for at least one year, without removal from the Easement by the Property Owner. The Site Plan submitted and approved in the fence permit is not the location where the fence is currently. 

Most recently, a first notice of violation has been sent to the Property Owner on July 15, 2021 requesting the fence be moved form the Easement to entirely on the Subject Property. 

Funding Source:

Staff handles all Code Enforcement cases as part of their regular duties. 

Recommendation:

Staff recommends motion to adopt Resolution #21-214 approving an abatement of 8405 167th Lane NW to remove fence in violation of City Code Section 117-111 regarding fence location on the Subject Property. The cost of the work will be assessed to the Property Taxes for the Subject Property.

Action:

Motion to adopt Resolution #21-214 approving an abatement of 8405 167th Lane NW.
