Adopt Resolution #21-207 Approving Lawful Nonconforming Uses and Boundary Agreement for Ken's Repair and Sales

An open code enforcement case from 2018 was recently followed up on and determined that the property had been brought back into compliance. To define the boundary and provide clarification for any possible future code enforcement regarding this property,  Staff has worked with the property owner to construct a resolution that outlines allowed uses, when a conditional use permit is needed, the activities on the property, and a plan for avoiding public nuisance complaints by determining storage areas, sales rows, and a 30-day schedule for hauling away old tires. 

This resolution is meant to clearly define uses, explain permits needed for new purposed uses or expansions, and how the property will designate locations to avoid public nuisance complaints caused by vehicles awaiting repair. 

No notification is required for this case.

Previously code enforcement violations on the property were for unlawful expansion with the following violations later discovered:

• vehicles in the wetland (shown as "low" in the site map)
• use of an RV as a dwelling
• accumulation of waste (tires)
• inoperable vehicles (non-roadworthy or expired tabs)

At this time, the property has been returned to the original foot print boundary, the vehicles removed from the wetland, and the RV was most recently in the process of being removed from the property. The conditions of the resolution are meant to proactively rid the property of the public nuisance violations such as accumulated waste (tires), and numerous inoperable vehicles; no tabs or expired tabs are considered inoperable.
