Title:

Introduce Ordinance #22-06 Amending City Code Chapter 117, Sections 1 and 351 Regarding Home Occupations

Purpose/Background:

Ordinance #22-06 (formerly #21-20) Amending City Code Chapter 117, Sections 1 and 351 Regarding Home Occupations. The revised sections regarding Home Occupations will address all business types conducted on a residential property.

This change is very minor and more administrative in nature.

Meetings

November 18, 2021: A public hearing was held at the Planning Commission. Planning Commission members approved motion to introduce ordinance to City Council.
December 14, 2021: Staff presented ordinance to City Council work session for feedback prior to introduction.
January 11, 2022: Ordinance was presented to City Council at regular session for introduction. Council requested revisions to proposed Ordinance and item to be brought to January 25, 2022 City Council work session.
January 25, 2022: Staff revised Ordinance based on Council input and presented revisions at City Council work session meeting.

Based on feedback from Council, Staff has made the following recent revisions:

The zoning administrator definition has been revised to include the fire marshal, chief of police, and any other designee.
Commercial vehicles, shown in the table, are subject to the off-street parking codes. Meaning that more than one signed vehicle is allowed, in accordance with section 117-355.
Home occupation permit holders shall be given reasonable notice if an inspection is requested. The inspection would include the area covered by the permit. E.g., a home occupation limited to an accessory structure, would not require an inspection of the principle structure.
The language for the death or move of a home occupation permit holder has been revised. The section has been separated, the death and desired continuous by the surviving family shall continued with written notice to the zoning administrator, subject to the same original terms.
- Should the occupation move to a new location, the permit may request the city council to authorize the occupation in the new location. This provides the opportunity for Staff and Council to ensure that the occupation will be harmonious with the proposed neighborhood, not cause disturbances, and allow public comment from the properties that would be near to the home occupation in the new neighborhood.

Notification:

The Public Hearing Notice for the November 18, 2021 Planning Commission meeting, was advertised in the Anoka County Union-Herald, the City's Official Newsletter.

After significant revisions to the original proposal to the home occupation section, a second Public Hearing Notice for the February 8, 2022 City Council meeting was advertised in the Anoka County Union-Herald.

Observations/Alternatives:

Alternative 1: Introduce Ordinance #22-06 as is.

Alternative 2: Introduce Ordinance #22-06 with revisions.

Alternative 3: Deny Ordinance #22-06.

Funding Source:

Staff is handling this as part of normal duties.

Recommendation:

The Planning Commission recommends that the City Council introduce and adopt Ordinance #22-06 (formerly #21-20) Amending City Code Chapter 117, Sections 1 and 351 Regarding Home Occupations.

Action:

Motion to introduce Ordinance #22-06 (formerly #21-20) Amending City Code Chapter 117, Sections 1 and 351 Regarding Home Occupations.
