Adopt Resolution #22-071 Approving Revised Assessment Agreements for Improvement Project #20-05, Riverdale Drive Extension, Llama Street to Bowers Drive

Purpose/Background:

Purpose
The purpose of this case is to adopt Resolution #22-071 approving Assessment Agreements for Improvement Project #20-05, Riverdale Drive Extension, Llama Street to Bowers Drive.
 
Background:
Improvement Project #20-05 proposes to extend Riverdale Drive between Llama Street and Bowers Drive to extend the frontage road system south of U.S. Highway 10/169 from Llama Street to Bowers Drive.  This project is consistent with the goals and objectives of the Highway 10 Access Planning Study completed in 2014 in partnership between the Minnesota Department of Transportation (MnDOT) and the Anoka County Highway Department, and broadly supported by partnering agencies including the City of Anoka, City of Ramsey, Anoka County, MnDOT, and the Metropolitan Council.
 
Extending Riverdale Drive between Llama Street and Bowers Drive will benefit abutting undeveloped properties by providing access and utilities to serve these properties upon development.
 
Pursuant to Resolution #21-185 adopted October 26, 2021, the City Council approved the cost share framework assigning costs for the Riverdale Drive extension to benefiting properties, including costs to be assessed against abutting properties.
 
Pursuant to Resolution #22-056 adopted February 22, 2022, the City Council approved three draft Assessment Agreements, one for each Pearson family ownership entity, related to Improvement Project #20-05, Riverdale Drive Extension, Llama Street to Bowers Drive, contingent upon receiving City Attorney approval as to legal form.
 
Copies of the three final Assessment Agreements signed by the Pearson family ownership entities on March 16, 2022, are attached to this case.

Notifications are not required for this case.   

Observations/Alternatives:

Alternative #1 – Adopt Resolution #22-071 approving revised Assessment Agreements related to Improvement Project #20-05, Riverdale Drive Extension, Llama Street to Bowers Drive.    

Funding Source:

Though individual assessment amounts for the three Pearson family ownership entities were revised, the total assessment apportioned between the three assessment agreements remains at $465,639 per the approved cost-share framework included as Exhibit C in the Assessment Agreements.  
 

Recommendation:

Staff recommends approving Alternative #1.   
 

Action:

Adopt Resolution #22-071 approving revised Assessment Agreements related to Improvement Project #20-05, Riverdale Drive Extension, Llama Street to Bowers Drive.
