Title
Adopt Resolution #22-132 Approving an Updated Final Plat of Riverside West Rearrangement and Authorization of Sale of Lot 4, Block 1, Riverside West Rearrangement
Purpose/Background:
The City Council approved the Riverside West Rearrangement Plat (the "Plat") on January 11, 2022. This Plat, which involves both 6650 and 6710 Highway 10 (the "Subject Properties"), was prepared after the elimination of the segment of Dolomite Street between Riverdale Drive and Highway 10. The intent was to 'square off' the adjacent lots. At that same meeting, the City Council introduced Ordinance #22-01 to vacate the public road right-of-way for the former segment of Dolomite Street. Ordinance #22-01 was adopted by the City Council on January 25, 2022. When the Plat was submitted to Anoka County for the 'plat check' process, it was rejected, prompting a need to revise the Plat and resubmit.
Lots 3 and 4 of the newly platted Riverside West Rearrangement need to be swapped in order to square off the ownership of the newly created lots. A lot combination to create a single tax ID for each parcel for each owner will be completed after the filing of the plat.

Observations/Alternatives:
Both of the Subject Properties are irregularly shaped and the intent was to equally divide the vacated right-of-way between the two abutting properties (per State Statute) to 'square them off' and thus, create more flexibility for development and/or building expansion. However, because the land is Torrens rather than Abstract, the Plat, as originally prepared, was not acceptable. Each parcel, including the portions of right-of-way, must be assigned its own lot and block number. Furthermore, the resolution needed to include additional language since the City was approving a Plat that involves City-owned land. Both the revised Final Plat and resolution are attached to the case.
Since City owned land will be swapped with the adjacent land owner, authorization for the sale of Lot 4, Block 1, Riverside West Rearrangement is required and included in the attached resolution.

Funding Source:
The City is responsible for all costs related to the plat of Riverside West Rearrangement.
Recommendation:
Staff recommends adopting Resolution #22-132 Approving a revised Final Plat of Riverside West Rearrangement and Authorization of Sale of Lot 4, Block 1, Riverside West Rearrangement.
