Title
Adopt Resolution #22-138 Approving Easement Agreement with Pearson Trustees for Riverdale Drive Extension, Llama Street to Bowers Drive, Improvement Project #22-05
Purpose/Background:
A perpetual easement for right-of-way purposes is needed to construct the proposed cul-de-sac on the north end of Bowers Drive over, under and across that part of Outlot A, Riverstone South.
The extension of Riverdale Drive from Llama Street to Bowers Drive is proposed to be constructed under Improvement Project #20-05 this fall. Plans are currently in for final review and approval by the Minnesota Department of Transportation (MnDOT). However, MnDOT will not sign the plans, allowing them to be advertised for bids, until this perpetual easement is received. To avoid potential project delays, Staff is therefore requesting Council approval of the attached draft easement agreement that, upon execution, will convey this perpetual easement.

Staff submitted two copies of the attached easement agreement to the property owners (Alan and Elizabeth Pearson) on May 27, 2022, and anticipate receiving the signed agreements no later than June 17th.
Resolution #22-138 conditions City Council approval on receipt of the property owners notarized signatures. After the agreements with notarized signatures are received, Staff will obtain signatures from the Mayor and City Administrator and record both agreements with Anoka County, which will allow MnDOT to sign the plans so Improvement Project #20-05 can be advertised for bids.
