Title
Adopt Resolution #23-039 Declaring Development Agreement Satisfied and Authorizing Release from Property - Lord of Life Church
Purpose/Background:
Lord of Life Church at 14501 Nowthen Blvd. NW is comprised of property that has been subdivided multiple times over the years. Portions of the property are still encumbered by two development agreements that are not associated with the Church itself. The western portion of the property was once a remnant outlot from the early-1990s Sunny Ponds residential subdivision to the northwest. In 2012, Lord of Life sold the southern portion of their property for development of the Stoney River senior living complex. These two development agreements are showing up on the Church's property title.
The Church is working with Presbyterian Homes on developing portions of the site for senior living and multi-family buildings. Cleaning up the title is just one of many steps for that project. It is not uncommon for property owners to request releases from satisfied development agreements or expired conditional use permits, especially when a property sale is anticipated. The property owner records the resolution approving the release against the property with the Anoka County Recorder's office.
Staff has reviewed the two development agreements and noted that all requirements have been fulfilled for Sunny Pons and is no longer needed on the Church's property. The other development, Stoney River, however, still needs as-built civil plans submitted to be complete. The proposed resolution does not release the agreements from the other properties as that would be more involved and costly to record. The proposed resolution only releases Sunny Ponds. Once the as-built plans for Stoney River are received, staff will bring forward another resolution.

Funding Source:
This request is being done as a normal part of staff's duties. Recording costs are the responsibility of the property owner.
Recommendation:
Staff recommends approval of the resolution.
Action:
Motion to waive the City Charter provision of reading a resolution aloud and adopt Resolution #23-039 Declaring Development Agreement Satisfied and Authorizing Release from Property.
