Title
Adopt Resolution #23-035 Authorizing Final Payment to Novco, Inc. for Improvement Project #22-01, Sunwood Drive and Waco Street Reconstruction.
Purpose/Background:
Resolution and Pay App Request Attached.
Observations/Alternatives:
Issuing final payment will be contingent on receipt of the following items from Novco, Inc.:
1. IC 134 (Contractor’s Withholding Affidavit showing compliance with the provisions of Minnesota Statute 290.92 requiring withholding state income tax)
2. Waiver of Mechanic’s Lien Rights (Affidavits that all claims against Novco, Inc. by reasons of the contract have been fully paid or satisfactorily secured)
3. Consent of Surety to Final Payment (Certification from the contractor’s surety) Following receipt of these items, final payment will be issued.
The final project cost was $590,508.66 compared to the awarded contract price of $560,896.85. This was an increase of $29,611.81. A large portion of this was due to increased quantities in curb and gutter replacement and bituminous paving. These increased quantities were identified during construction due to the poor existing conditions of materials, and were determined to be necessary to achieve a minimum life of 60 years from the improvements.

Recommendation:
The Senior Engineering Technician has inspected the completed work and recommends final payment to Novco, Inc., of Elk River, Minnesota, for said project, in the amount of $9,197.09.
Action:
Motion to adopt Resolution #23-035, Authorizing Final payment to Novco, Inc., of Elk River, Minnesota for Improvement project #22-01, Sunwood Drive and Waco Street Reconstruction, in the amount of $9,197.09.
