Title
Adopt Resolution #23-117 Approving Final Plat, Development Agreement, Encroachment Agreement, and Shared Access Agreement for "Ramsey Properties Addition"
Purpose/Background:
On May 9, 2023, the City Council approved the preliminary plat and site plan related to the proposed Hilton Home2Suites hotel at the northwest corner of Sunwood Drive and Zeolite St. NW for Ramsey Properties, LLC. The proposed action would be to approve the remaining four items related to this project: the final plat, the development agreement, an encroachment agreement for the patio, and a cross access and maintenance agreement for the shared driveway.
Plat
The proposed final plat of Ramsey Properties Addition subdivides a 30.77-acre property into one 2.8-acre lot for the proposed hotel with the remainder as an outlot for future subdivision and development. The proposed final plat is consistent with the approved preliminary plat. It should be noted that there is a 100-foot gap in the drainage and utility easement adjacent to Sunwood Drive. This is to accommodate a separate storm sewer easement document that is being dedicated to the City. The intent is to narrowly define the scope of the easement where the patio will be encroaching so other private utilities do not disrupt the patio area.
Development Agreement
The proposed development agreement is the City's standard agreement that lays out all of the financial expectations for the project and construction expectations.
Encrochment Agreement
The site plan includes a patio along Sunwood Drive that will be partially constructed in a storm sewer easement. The easement is necessary for the large storm sewer underneath the north edge of Sunwood Drive. The storm pipe itself is not under the proposed patio area. The easement area is needed in the event the pipe ever needs to be dug up. The encroachment agreement is based on the City's standard document. The agreement commits the City to providing reasonable notice to the property owner in the event a construction project is going to happen so that they can remove whatever items they can.
Shared Access Agreement
The driveway at the northwestern corner of the site will be shared between the Hotel and the eventual users to the north. The property line runs through this shared driveway. The agreement established rights of both land owners to use the area on the other owner's property for ingress and egress. It also requires cooperation and joint financial participation for maintenance activities.

Funding Source:
Costs associated with this project are paid for by the developer, Ramsey Properties LLC.
Recommendation:
Staff recommends approval of Resolution #23-117.

Motion to Adopt Resolution #23-117 approving the final plat, development agreement, encroachment agreement, and reciprocal ingress/egress easement agreement for "Ramsey Properties Addition."
