Title
Adopt Resolution #23-153 Denying a Rental License to Duane Rosen at 15443 Ramsey Blvd. NW
Purpose/Background:
Mr. Duane Rosen submitted a rental license application for a single-family home at 15443 Ramsey Boulevard NW. The application was a result of several complaints of property conditions--vehicle conditions, structure conditions, outdoor storage issues, among others. During inspections of the property, Ramsey Zoning Code Enforcement Officer Craig Swalchick discovered that the property was being rented and no license existed. It was also discovered that work had been done on the structure without the required building permits and the septic system lacked the required inspection when the property was recently sold. After failing to bring the non-complying issues into compliance, Mr. Rosen was charged criminally (at his request) in court.
Mr. Rosen eventually did apply for a rental license on June 5. As part of the licensing process, City Code Section 26-650C allows for an inspection of the property when it is believed there are Code violations on the premises. An inspection was scheduled with one of the City's Building Inspectors, Thomas Knight. This was done so that Mr. Knight could assist the property owner with any of the building permit or septic system related issues as well as the general property maintenance to protect the health, safety, and welfare of the residents of that home and the surrounding neighbors. Mr. Knight stated that he showed up promptly at the scheduled time and that it appeared that someone was home due to cars being in the driveway and the windows open. He also stated that he knocked and waited and when nobody answered after a reasonable amount of time, he left.
Staff has been trying to work with Mr. Rosen, though no progress has been made on the property conditions and it still generates complaints from the public. Since Mr. Rosen submitted an application, it must be either approved or not approved.

1. Deny the rental license based on the findings in the attached resolution as recommended by staff.

Funding Source:
Costs associated with this request are being handled in the course of staff's normal duties though time spent on this property far exceeds the $25 currently charged for rental licenses.
Recommendation:
Staff recommends adopting the resolution to deny the rental license.
