Adopt Resolution #23-172 Approving MnDOT Cooperative Construction Agreement #1052605 for Ramsey Gateway Highway 10 Improvements

Purpose/Background:

Purpose:
The purpose of this case is to adopt Resolution #23-172 approving MnDOT Cooperative Construction Agreement #1052605 for Ramsey Gateway Highway 10 Improvements.  

Background:
Anoka County proposes to construct grade-separation improvements on CSAH 56 (Ramsey Blvd) and CSAH 57 (Sunfish Lake Blvd) at the BNSF Railway and U.S. Highway 10 crossings to improve traffic operations and safety.  The proposed improvements were designed and will be constructed in partnership with the City of Ramsey and the Minnesota Department of Transportation (MnDOT). This project has been designated as the Ramsey Gateway Highway 10 Improvements, City Improvement Project #20-11.
 
The proposed improvements generally include reconstructing portions of U.S. Highway 10/169, CSAH 56/Ramsey Boulevard, CSAH 57/Sunfish Lake Boulevard, and Riverdale Drive; constructing new frontage roads to remove private accesses onto Highway 10; constructing sidewalks, trails and pedestrian curb ramps; constructing bridges and roundabouts; extending/reconstructing municipal utilities; constructing a temporary traffic control signal system; establishing turf; and installing striping and signing.
 
Construction of the Ramsey Gateway Highway 10 Improvements project began this Summer with temporary widening improvements, and is proposed to conclude in 2026, with the vast majority of work occurring in 2024 (primarily on Sunfish Lake Boulevard) and 2025 (primarily on Ramsey Boulevard). 
 
The Ramsey Gateway Highway 10 Improvements project was recently bid and Anoka County is currently in the process of awarding a construction contract to the lowest responsible bidder. To memorialize cost sharing splits and maintenance responsibilities, MnDOT prepared attached Cooperative Construction Agreement #1052605.  In general, this agreement provides for payment by the City to the State of the City's share of the costs of the construction engineering in connection with the City water main and sanitary sewer construction, as well as to define the City’s maintenance responsibilities for various infrastructure constructed as part of the Ramsey Gateway Highway 10 improvements project.
 
Also attached is a copy of the cover letter that accompanied MnDOT Cooperative Construction Agreement #1052605 when submitted to the City for review and comment. 

Upon adoption of Resolution #23-172, a certified copy of the Resolution will be submitted to MnDOT, along with a copy of MnDOT CCA #1052001 with City signatures.

Observations:
City staff reviewed attached MnDOT Cooperative Construction Agreement #1052605 and has no concerns or comments.
 
The City Attorney also reviewed attached MnDOT Cooperative Construction Agreement #1052605 and has no concerns or comments, and has approved the agreement as to legal form.
 
Upon approving MnDOT Cooperative Construction Agreement #1052605, the City will be responsible for maintaining all infrastructure identified in attached exhibits A, B, C, D, and E after construction is complete and the City has accepted the project. This is similar to the responsibilities assumed by the City following the completion of construction of the Armstrong Boulevard Interchange. 

Funding Source:

As defined within attached MnDOT Cooperative Construction Agreement #1052605, the City is responsible for paying the State $11,021.57 for the City's share of the State's costs of the construction engineering in connection with the City water main and sanitary sewer construction.
 
As outlined on page 4 of the attached executed Joint Powers Agreement, the City’s lump sum cost share contribution for this project is set at $4,000,000, which is proposed to be funded using $2,000,000 of Public Improvement Revolving (PIR) Funds and $2,000,000 of Municipal State Aid (MSA) Funds.  The City's lump sum contribution pays for the City’s share of project costs for design, right-of-way acquisitions, construction, and construction engineering expenses.
 
The City’s first installment of $1,500,000 was recently paid in equal installments of $750,000 each from the PIR and MSA funds. The City will be required to pay another $1,000,000 on March 1, 2024, with another $1,500,000 due on March 1, 2025.  

Recommendation:

The City Attorney reviewed and approved MnDOT CCA #1052605 as to legal form.
 
Staff recommends approving MnDOT CCA #1052605.  

Action:

Motion to adopt Resolution #23-172 approving MnDOT Cooperative Construction Agreement #1052605 for Ramsey Gateway Highway 10 Improvements.
