Title:

Adopt Ordinance #23-16 Amendment to Chapter 16, Article XIV Rental Residential Dwelling Units

Purpose/Background:

At the August 22, 2023 City Council meeting, Ordinance #23-16 was introduced. The amendment to Chapter 26, Article XIV. Rental Residential Dwelling Units updates the application requirements for rental licenses, associated fees, inspection process, and creates a crime-free housing program, in which all rental properties will be a part of. Changes will require an annual renewal of rental licenses and annual interior inspections of rental units. The intent of the changes is to create a rental inspection program for the good of all residents in and around rental properties that focuses not only on items described in the Crime-Free Housing Program, but that would equally benefit all tenants and the respective property owners.

At the time of the ordinance introduction, there was a council suggestion to ensure a "current" state issued drivers license or identification card is provided; therefore, in Section 26-646. Application a(8), the word "current" has been added.

The draft Ordinance #231-16 is attached for your review.

 

Notification:

If the ordinance is adopted, rental license holders will be notified in September 2023 regarding the changes that will be effective January 1, 2024.

Time Frame/Observations/Alternatives:

If the ordinance is adopted, it will be published for 30 days and will become effective on January 1, 2024.

City Council may consider the following options:
1. Motion to adopt or deny the ordinance as written
2. Motion to adopt or deny ordinance with modifications

Funding Source:

Annual rental license fees will be collected. Annual fees will be approved as part of the 2024 Rates and Fees Schedule and will become effective January 1, 2024. The annual license fees collected will cover the costs of the rental inspections program; including staff time of the rental housing inspector, police, fire, the purchase of an inspection vehicle, miscellaneous equipment and all other associated fees.

Recommendation:

Staff recommends the adoption of Ordinance #23-16.

Outcome/Action:

Motion to waive city charter requirement that the ordinance be read outloud and adopt Ordinance #23-16 Amendment to Chapter 24, Article XIV Rental Residential Dwelling Units.
