Title:

PUBLIC HEARING: Adopt Resolution #25-130 Vacating Right-of-Way Easements in Trott Brook Crossing.

Purpose/Background:

173rd Avenue NW is a rural unpaved roadway that provides access to the Trott Brook Crossing subdivision, North Brook Meadows (preliminary Plat approved in 2022), and one private residence (7031 173rd Avenue NW).   The approved preliminary plat of Trott Brook Crossing included a realignment of 173rd Avenue and will be dedicated in the upcoming plat of Trott Brook Crossing 3rd Addition.  The south half of the right-of-way is proposed to be vacated and helps facilitate that realignment.  The northern half will be brought forward for vacating as the North Brook Meadows final plat comes forward (expected Fall 2025).  The north half has no bearing on the Trott Brook Crossing 3rd Addition application.

There are two portions of this right-of-way proposed to be vacated.  The western portion was dedicated via an easement granted by quitclaim deed.  The eastern portion appears to be granted through prescriptive rights and re-affirmed with the first plat of Trott Brook Crossing.   

The one private residence will lose direct frontage to 173rd Avenue as the roadway is realigned.  The resident is the seller of the land that was platted as Trott Brook Crossing and has been working with the developer on relocating the driveway until such time that the North Brook Meadows property north of 173rd Avenue and to the east of 7031 can provide a permanent access.  In the meantime, Lot 6, Block 2, Trott Brook Crossing 3rd Addition will be set aside to provide a driveway connection to the rerouted 173rd Avenue.  

Notification:

Public notice was placed in the May 9 Anoka Union Hearld Newspaper.  Private utility companies were emailed the public hearing notice and vacation exhibits 30 days prior to tonight's hearing.  Mailed notices were sent to property owners within 350 feet.  

Of the responding utility companies, Lumen noted that they have facilities in that corridor. The applicant is working with them on relocation with the new street alignment.

All costs associated with this request are the responsibility of the applicant. 

Recommendation:

Staff recommend vacating the right-of-way as requested by the applicant.
