Consider Recommending City Council Approval of MnDOT Limited Use Permit #0200-0113 

Purpose:
The purpose of this case is to consider recommending City Council approval of MnDOT Limited Use Permit #0200-0113.  

Background:
The City of Ramsey is currently party to three (3) separate Limited Use Permits (LUP’s) with the Minnesota Department of Transportation (MnDOT) that allow the city to occupy certain segments of State-owned right-of-way along Trunk Highways 10 and 47 for the purpose of operating and maintaining city-owned pedestrian trails based on certain conditions specified within each permit.
 
The 3 existing LUP’s include;

• LUP #0202-0030 issued 5/18/2016 for trail segments south of Trunk Highway 10
• LUP #0206-018 issued 9/06/2005 for trail crossing under Trunk Highway 47 at Elmcrest Park
• LUP #0206-0028 issued 3/07/2017 for trail segments east of Trunk Highway 47 generally south of a point 900-feet north of Xkimo Street    

 
During discussions with MnDOT concerning their proposed 2028 mill and overlay project, MnDOT informed staff they wanted to replace the three existing LUP’s with a new city-wide LUP to minimize administrative efforts in the future.  City staff agree this would benefit both parties moving forward.
 
Attached is a draft copy of city-wide LUP #0200-0113.  Also attached are copies of the three existing LUP’s.
 
Following Committee recommendation for City Council approval of LUP #0200-0113, staff will request City Council approval of LUP #0200-0113 via Resolution.   

Observations:
City staff reviewed attached LUP #0200-0113 and submitted minimal comments to MnDOT, which were also shared with the City Attorney.  The City Attorney generally agreed with staff’s comments and approved the permit document as to legal form, but asked if the permit could be executed without a termination date. Staff is currently checking with MnDOT to see if they are open to this.
 
The conditions of the new city-wide permit do not require the city to assume additional maintenance or operational responsibilities.  

Alternatives:
Alternative No. 1:   Motion recommending City Council approval of MnDOT Limited Use Permit #0200-0113.  

Alternative No. 2:   Motion of other.  

There are no costs or fees required to execute LUP #0200-0113, other than staff time. 

Staff recommends approval of MnDOT LUP #0200-0113.
