Title:
Adopt an Ordinance to Amend City Code Chapter 6 - Alcoholic Beverages, Article I, Sec 6-4 consumption in Public Places
Background:
Current City Code does not allow for the consumption of alcohol in public places other than on the premises of an establishment licensed by the city. At an August 13, 2012 City Council Work Session, staff reviewed with council, cases where allowing alcohol in public places may be acceptable. An establishment licensed in the city to serve alcohol within their premises could be allowed to have outdoor seating on the public sidewalk if allowed in City Code. The City has a unique situation of a plaza area adjacent to a new restaurant location that may be available for alcohol consumption if allowed by City Code. The plaza area may be open to other licensed liquor establishments by special permit if consumption in public places is allowed. This Ordinance was introduced by the City Council at their August 28, 2012 regular meeting.
Recommendation:
Staff recommends changing the ordinance to allow for consumption of alcoholic beverages in public places by permit or license.
