Review of Draft Lower Rum River Watershed Management Organization (LRRWMO) Joint Powers Agreement (JPA)

The Lower Rum River Watershed Management Organization (LRRWMO) member cities are in the process of reviewing the draft Joint Powers Agreement (JPA) and associated resolution.  The reason for the amended JPA is that the current JPA is due to expire at the end of 2014.  The board would therefore like the draft JPA reviewed and approved before the current JPA expires.

The LRRWMO Board has asked the City Administrators/Managers of member cities, as well as other key city staff including City Attorneys, City Engineers, etc., to review the draft JPA and resolution and to provide comments.  The LRRWMO Board will then discuss all comments received at their next meeting scheduled for Thursday, May 16, 2013.  However, if no comments are received the LRRWMO will send a copy of the JPA to all member cities to execute.

Attached is the draft LRRWMO JPA and resolution as discussed by the LRRWMO Board at their last regular meeting on April 21st for reference and review.

Staff recommends approving the draft JPA amendment.  The only amendments being proposed are the sunset date, which is moving from January 1, 2015 to January 1, 2025, and the ability to terminate the agreement if the Commission membership drops below three members and there is unanimous consent to terminate.

No funds are required as a result of this item. 

Council is asked to review the attached draft JPA and resolution and to provide comments to staff for discussion with the LRRWMO on May 16th.
