Title

Adopt Resolution 15-04-108 Approving Right of Entry Agreement for Construction of the Highway 10 and Armstrong Boulevard Interchange

Purpose/Background:

Purpose:
Anoka County is requesting that the City of Ramsey adopt Resolution 15-04-108 for the purpose of allowing the County to complete work on certain City owned properties, right-of-ways and easements while constructing the Highway 10 and Armstrong Boulevard Interchange.

Background:
The City of Ramsey owns numerous properties, right-of-ways, and easements throughout the Highway 10 and Armstrong Boulevard Interchange project area.  Anoka County is requesting that the City grant the County and their agents and assigns right of entry across these properties, right of ways and easements while constructing the interchange improvements.

Attached are two exhibits showing the parcels where right of entry is being requested. Exhibit A contains a listing of the parcels, and Exhibit B maps the locations of the parcels.

No notification was required for this case.

Observations/Alternatives:

Observations:
Anoka County is in the process of reviewing the attached Right of Entry Agreement drafted by the City Attorney.  However, due to the pending start of construction for the Highway 10 and Armstrong Boulevard Interchange project, Council is being requested to adopt Resolution 15-04-108 to help avoid any construction delays.

Alternatives:
Alternative Action #1 – Motion to adopt Resolution #15-04-108 approving the attached Right of Entry Agreement for construction of the Highway 10 and Armstrong Boulevard Interchange contingent on review and approval by Anoka County staff and legal counsel.

Alternative Action #2 – Motion to adopt Resolution #15-04-108 approving the attached Right of Entry Agreement for construction of the Highway 10 and Armstrong Boulevard Interchange contingent on review and approval by Anoka County staff and legal counsel after the following modifications are made: ____________________.

Alternative Action #3 – Motion to deny adoption of Resolution #15-04-108 at this time.

Funding Source:

The costs for the City Attorney to draft the attached agreement are proposed to be paid through the City Attorney's annual retainer fund.

Recommendation:

The City has been an active partner throughout the development of the Highway 10 and Armstrong Boulevard Interchange project due to the many benefits the City will receive as a result of this project.  Staff therefore recommends Council adoption of Resolution 15-04-108 approving the attached Right of Entry Agreement to allow construction to occur on the identified parcels per approved plans and specifications.

Action:

Approve or deny adoption of Resolution #15-04-108.
