Title:

Adopt Resolution #15-04-107 Accepting Access Easement and Permanent Sign Easement from Casey's General Stores, Inc.

Purpose/Background:

As part of the approved Site Plan, Plat, and Purchase Agreement for Casey's General Store, several easements were required. These easements included the following:
 
  1. Access Easement for private driveway access to Sunwood Drive
  2. Sign Easement for future development signage at Sunwood Drive and Ramsey Boulevard

Notification:

No notification is required.

Observations/Alternatives:

Access Easement

In order to ensure future, shared access along Sunwood Drive, the City required a shared access with future development on the west edge of the Casey's development. It is anticipated that this will remain a private access that will be sold at a future date with the remainder of the undeveloped portion of this block. It is not anticipated that this will become a future public street. This approach will eliminate the potential for multiple future access points on Sunwood Drive for individual developments. This will be important from a public safety aspect as the area continues to develop, especially given existing turn lanes and proximity to Ramsey Boulevard.

Sign Easement

The City requested a Sign Easement at the corner of Sunwood Drive and Ramsey Boulevard for the purposes of a future development identification sign for The COR. This sign could also include individual tenant panels. The City designed said sign at this time; however, reserves the right to do so at a future date.

Alternatives

Alternative #1: Accept Easements as drafted. The easements have been reviewed by the City Attorney and are acceptable to legal and policy form. The easements are in line with the approved site plan.

Alternative #2: Do not accept the easements. If the City does not accept the access easement, the site plan and plat will need to be re-drawn. This does not appear to be necessary as the site plan has already been approved. The Sign Easement is more voluntary. By not accepting the Sign Easement, the Master Sign Plan would need to be modified, as the entryway/gateway sign for The COR at this location would likely no longer be feasible.

Funding Source:

The costs of the review of the easements are the responsibility of the Application.

Recommendation:

Staff recommends accepting the proposed easements.

Action:

Motion to adopt Resolution #15-04-107 Accepting Access Easement and Permanent Sign Easement from Casey's General Stores, Inc., subject to the review and approval by the City Attorney as to legal form.
