Title
Adopt Resolution Vacating Drainage and Utility Easement and Release of Development Agreement for Outlots A & E, SWEETBAY RIDGE Related to COUNTRY CLUB HILLS; Case of Lennar Homes
Purpose/Background:
The purpose of this case is to vacate a drainage and utility easement and release the Development Agreement for Outlots A & E, Sweetbay Ridge. The drainage and utility easement is no longer necessary, even without further development. There are no outstanding obligations on these outlots that would necessitate retaining the Development Agreement.
Notification:
Notification not required.
Observations/Alternatives:
Lennar Homes is in the process of purchasing the project known as Country Club Hills from Greatland Homes, LLC. As part of that due diligence process, Lennar is asking that two (2) encumbrances be removed as noted above.
Funding Source:
All costs associated with processing the application are the responsibility of the Applicant.
Recommendation:
Staff recommends approval of both actions.
Action:
Motion to adopt Resolution #15-05-128 vacating the drainage and utility easement recorded as Anoka County Document No. 129004 and approve the Release of Development Agreement for Outlots A & E, Sweetbay Ridge.
