Title
Adopt Resolution #15-05-116 Accepting Temporary Road Easement from Brookfield Land LLC over a Portion of Lot 10 Block 3 Brookfield 4th Addition
Purpose/Background:
Brookfield Land, LLC has submitted a Building Permit for a new single family home on Lot 10 Block 3 Brookfield 4th Addition, generally known as 7008 168th Ave NW (the "Subject Property"). Per approved plans, a portion of the temporary cul-de-sac encroaches onto the northeast corner of the Subject Property.
Notification:
No notification is required.
Observations/Alternatives:
The eastern terminus of 168th Lane NW within Brookfield 4th Addition ends in a temporary cul-de-sac at the eastern boundary of the plat. The temporary cul-de-sac partially encroaches on the northeast corner of the Subject Property. Brookfield Land, LLC, has provided a Temporary Road Easement to encumber this encroachment in favor of the City. When 168th Lane NW is extended to the east for future development, the cul-de-sac will no longer be necessary and the City would then vacate this easement.
Alternatives
Option #1: Accept the Temporary Road Easement subject to review and approval by the City Attorney as to legal form. The easement would properly address the existing encroachment and would be vacated once 168th Lane is extended to the east to facilitate future development. Staff supports this option.
Option #2: Do not accept the Temporary Road Easement. If the City does not accept the Temporary Road Easement, a portion of the cul-de-sac will need to be removed to eliminate the encroachment. This may reduce the radius of the cul-de-sac such that it would not have sufficient turn-around space for larger motor vehicles. Staff does not support this option.

Action:
Motion to adopt Resolution #15-05-116 accepting a Temporary Road Easement over a portion of 7008 168th Lane NW, subject to review and approval by the City Attorney as to legal form.
