Title:
Adopt Resolution #15-05-138 Approving Revised Development Agreement for Country Club Hills; Case of Lennar Homes
Purpose/Background:
The purpose of this case is to approve a revised Development Agreement for the first phase of Country Club Hills. The revised Development Agreement assigns the obligations to U.S. Home Corporation doing business as Lennar. Lennar homes recently purchased the project from Greatland Homes, the previous Applicant/Developer on the project approved in 2014. This phase represents 32 lots.
Lennar Homes plans on commencing construction the week of May 25 following City Council approval of the Development Agreement. Lennar would also like permission to begin tree clearing in advance of executing the Development Agreement and recording the Plat.

Observations/Alternatives:
Alternatives
Alternative #1: Approve the revision to the Development Agreement as presented. No substantive changes have been requested by Lennar. The revision is focused on the change to the actual developer. Lennar Homes has demonstrated quality projects in other areas of the Minneapolis/Saint Paul metropolitan area, throughout the State, and in other states around the Country. Given that the project was previously approved and proper securities will be in place, Staff recommends this alternative.
Alternative #2: Approve an amended Development Agreement. This alternative would be based on discussion. Staff has not identified additional revisions necessary at this time.
Alternative #3: Do not approve a revised Development Agreement. Staff does not recommend this option as approval has already been given to the project.

Funding Source:
All costs associated with processing the Application are the responsibility of the Applicant.
Recommendation:
Staff recommends approval of the revised Development Agreement and authorization to begin tree clearing. A Tree Preservation and Replacement Plan is already in place for the development.
Action:
Motion to adopt Resolution #15-05-138 approving a revised Development Agreement for Country Club Hills and authorizing commencement of tree removal.
