PUBLIC HEARING: Adopt Resolution #16-04-060 Ordering Plans and Specifications for Improvement Project #16-00, Division B; 2016 Mill and Overlay Improvements

Purpose/Background:

Purpose:
The purpose of this case is to conduct a public hearing and consider ordering plans and specifications for Improvement Project #16-00, Division B; 2016 Mill and Overlay Improvements.

Background:
On February 8th, 2016 the Ramsey City Council ordered a Feasibility Report for Division B of the 2016 Street Maintenance Program which proposes to mill and overlay existing bituminous pavement sections on approximately 0.8 miles of Sunwood Drive between Sunfish Lake Boulevard and the bridge between 147th Lane and Krypton Street.  Figures showing the general project location and scope of work are included in the attached Feasibility Report.

On March 22nd, 2016, the Ramsey City Council accepted the Feasibility Report and ordered this evening’s Public Hearing.  The purpose of the Public Hearing is to present information about the project to the public, including a description of the proposed improvements, estimated project costs, and proposed funding sources which includes levying special assessments against three benefiting properties.  Property owners may then address Council with any questions or concerns they have regarding the project, including proposed funding sources, prior to Council consideration of ordering plans and specifications.

City staff visually inspects each public street segment throughout the City annually to determine pavement conditions.  Staff uses the Pavement and Surface Evaluation Rating (PASER) method to assign a numerical rating between 1 and 10 to each street segment.  Streets rated at 1 are considered to need a complete reconstruction, while streets rated at 10 are considered to be new pavement sections.  The segment of Sunwood Drive proposed to receive mill and overlay improvements in 2016 has PASER ratings between 4 and 5 making it a timely candidate for mill and overlay improvements.  The proposed improvements should extend the life of the pavement approximately 20 years.

This segment of Sunwood Drive was constructed in 1996 with B618 concrete curb and gutter, a storm sewer system, and an average of 3½ inches of bituminous pavement over 4 inches of class 5 aggregate base.  The street is 30 feet wide between Sunfish Lake Boulevard and 145th Lane, and 40 feet wide over the remainder of the segment.  The right-of-way is 80 feet wide throughout.  Sanitary sewer and water supply systems exist throughout this segment of Sunwood Drive, though both are in good operating condition and require no improvements as part of this project.

Proposed improvements include the removal and replacement of approximately 200 feet of damaged sections of concrete curb and gutter, milling 2 inches of bituminous pavement off the top of the existing pavement, adding 2 inches of new bituminous pavement on top of the existing base course, and completing other appurtenant improvements including casting adjustments and upgrades to at least two pedestrian curb ramps.
 
According to the attached Feasibility Report, this project is necessary, feasible, and cost-effective from an engineering standpoint, and can be constructed as proposed herein.

Notification:

As required by State Statute 429.031, public hearing notices were mailed to all three property owners proposed to be assessed for a portion of the improvements, were posted in the Municipal Center, and were published in the City’s official newspaper.

Observations/Alternatives:

The proposed improvements are consistent with the City’s long-term Street Maintenance Program.

A public information meeting was held from 6:00 to 7:30 pm on Wednesday, April 6th to present information on the proposed project to interested property owners around the project area.  Meeting notices were mailed to over 250 properties, and  8 property owners attended the meeting.  None of the three property owners proposed to be assessed for a portion of the project costs attended.  Questions asked of City staff in attendance, which included the City Engineer and Public Works Superintendent, were generally to verify that they would not be assessed for the work, whether any roads would be closed during construction, and how long the proposed improvements would last.
 
Staff received several phone calls and emails regarding the project, but based on all public feedback received to date the public seems to understand the need for the improvements and supports them.  Only one of the property owners proposed to be assessed for the improvements contacted staff, and after submitting information as to why his property was proposed to be assessed for the improvements there was no further contact.  Staff therefore does not anticipate receiving any objections to the improvements during the Public Hearing.

Alternatives:
Alternative #1 – Motion to adopt Resolution #16-04-060 ordering plans and specifications for Improvement Project #16-00, Division B; 2016 Mill and Overlay Improvements.

Alternative #2 – Motion to deny adoption of Resolution #16-04-060 at this time.

Funding Source:

Plans and specifications are proposed to be completed in-house as part of staff’s regular duties.

The Engineer’s opinion of probable costs for this project is $301,000 which includes 5% contingency costs and 14% indirect costs for administrative, engineering, and legal costs.

This improvement project is identified in the City’s 5-year Capital Improvement Plan, and is proposed to be funded using a combination of Street Reconstruction and Overlay Plan bond proceeds per the City’s 5-year Street Reconstruction Overlay Program and special assessments.
 
Special assessments are preliminarily proposed in the amount of $950 per benefiting property as identified within the Feasibility Report.  This includes three properties having direct access to the improved segment of Sunwood Drive.  The proposed assessment rate is intended to recover 25% of eligible project costs based on estimated project costs identified within the Feasibility Report, and based on adopted assessment rates for previously completed mill and overlay projects.  Each property proposed to be assessed for the improvements will receive the same level of benefit so the proposed assessment rate is applied equally to each.  The “per lot” assessment method is recommended due to the similar benefit that will be realized by each property. The proposed use of special assessments conforms to the requirements set forth in State Statute Chapter 429, chapter 8 of the City Charter, applicable City code, and the recently adopted Special Assessments Policy.
 

Recommendation:

Staff recommends approving alternative #1.
 

Action:

Approve Resolution #16-04-060 ordering plans and specifications for Improvement Project #16-00, Division B; 2016 Mill and Overlay Improvements.
