Title:
Consider Advisory Response to City of Anoka Regarding Site Plan Approval at 6058 Highway 10 NW for Relocation of Riverplace Counseling
Purpose/Background:
The purpose of this case is to consider an advisory response to the City of Anoka regarding the proposed relocation of Riverplace Counseling, a State licensed Residential Treatment Facility, to 6058 Highway 10 NW on the border with the City of Ramsey. The impetus behind sending an advisory response is a result of public comment from Ramsey residents, but also due to the fact the City of Ramsey is considering a Joint Powers Agreement (JPA) for sanitary sewer service to this location. With this in mind, Staff wants to ensure that this is an acceptable land use approval per Anoka Codes if the City of Ramsey is to enter into a legal contract.

Notification:
The City of Ramsey attempted to notify all residential property owners along Rivlyn Avenue of a workshop held on April 21, 2016. Staff from the City of Anoka was present at this workshop to answer questions about the proposal.
Observations/Alternatives:
The proposed site plan would create five (5) residential buildings consisting of two (2) units each. This calculates to a total of ten (10) residential units. Each residential unit is proposed to have two (2) bedrooms. Each residential unit is planned to house four (4) occupants, which is two (2) per bedroom. This calculates to a total of forty (40) occupants. There is also the potential for future expansion for two (2) more buildings, for a total of fifty-six (56) inpatient residents.
Additionally, Riverplace Counseling provides outpatient services in a proposed community building. Anoka Staff has indicated that this community building has the capacity to serve up to sixty (60) outpatient guests (daytime only, no overnight stay). The proposed relocation would consolidate several of Riverplace Counseling's current buildings on Ferry Street (US 169). Details on this request are included in the attached Staff Report from the City of Anoka. Staff has kept this summary brief, deferring to the full Anoka Report, to avoid conflicting language.
The proposed use does require a Zoning Amendment to Anoka's Official Zoning Map, as the proposed use is not currently a permitted use under that Zoning District. The request includes a Zoning Amendment to Planned Unit Development (PUD), which would allow the mix of uses as proposed (outpatient center and residential/inpatient units).

According to the Riverplace Counseling website, Riverplace Counseling provides primary chemical dependency therapy programs and related services with a mission to provide highly structured chemical dependency care in the least costly, least restrictive, non-institutional manner possible, consistent with the individualized needs of person they have an opportunity to serve.

Anoka Staff has been working through the following potential deviations to the Critical Area Overlay dimensional standards.
- Bluff Setback. The Executive Order for the Mississippi River Corridor Critical Area (MRCCA) establishes a minimum setback to bluff lines of 40 feet through 'interim development regulations' for the 'Urban Diversified' district of the Overlay. It is Staff's understanding that this provision would remain the same under the proposed rule changes for the Critical Area. However, this provision is not found in Anoka's existing ordinance. The proposed Bluff Setback is only 30 feet, which is Anoka's current standard (voluntary). It appears that the Minnesota Department of Natural Resources (DNR) has recommended that this setback be amended to 40 feet to comply with existing MRCCA rules and proposed amendments to MRCCA rules. Additionally, Anoka is choosing to employ the use of a Planned Unit Development (PUD) for this dimensional standard, which is a commonly employed tool. Staff simply requests that Anoka verify that this approach is acceptable under the Critical Area standards.
- Water Setback. The Executive Order for the Mississippi River Corridor Critical Area (MRCCA) establishes a minimum setback to the 'Ordinary High Water' mark (OHW) of 100 feet through 'interim development regulations' for the 'Urban Diversified' district of the Overlay. However, this provision is not found in Anoka's Ordinance. Several of the proposed structures appear deficient in this setback. Additionally, Anoka has indicated that this is not a riparian lot, and is not subject to the OHW Setback, as the City of Anoka will retain a small strip of property along the shoreline. The DNR has not commented on this issue. Ramsey simply requests that Anoka verify that this is an acceptable approach within the Critical Area Overlay.
- Pedestrian Connectivity. The proposed site plan lacks any immediate pedestrian connectivity to existing facilities. Given the fact that residents generally do not have vehicles at this facility, there are lack of options to arrive at area destinations outside of structured events. There are longer term plans to connect to the Mississippi River Trail to the south by a future connection to the east of this site, but there is no current timetable nor funding for these improvements. There will be a gap in time between opening of the proposed facility and any future pedestrian facility connections.
- How many pedestrian trips will this generate?
- Is there a better location within Anoka where this could be located?
- Does the program accept individuals with pending criminal cases?
- Is there sufficient parking for the potential parking demand?
- Would Riverplace Counseling consider a shuttle service in lieu of the lack of pedestrian connectivity?
- Why didn't the City of Ramsey comment on this proposal sooner?

This case is being handled as part of normal Staff duties.
Recommendation:
Staff recommends that the City Council forward the site plan concerns and public comment to the City of Anoka. Staff recommends that the City Council not provide a recommendation on the use itself, as the City of Anoka has jurisdiction over this Land Use Application. Finally, Staff does recommend that the City Council forward the comments to the DNR as well as it relates to the compliance with the Critical Area Overlay District.
Action:
Motion to forward the attached response to City of Anoka regarding the site plan for Riverplace Counseling.
