Title:
Discussion of Regulations and Restrictions in Regard to Municipal Authorities
Purpose/Background:
Purpose: To further discuss the Commission's ability to restrict the Economic Development Authority.
Background: Prior to the Charter Commission meeting held on July 13, 2016, a Charter Commissioner expressed concern regarding the Economic Development Authority and whether the Commission could impose some constraints on the EDA (i.e. bonding, etc.). It was stated at the July meeting that there is no Charter language pertaining to Authorities, so state law would prevail. Following a discussion at the meeting, the Commission determined they would like some follow-up at a subsequent meeting with regard to Authorities and restrictions. The Commission also asked for a copy of the resolution establishing the Economic Development Authority. That Resolution is attached. The resolution enabling the creation of an Economic Development Authority, adopted in 1998, gave the EDA the rights of an EDA and an HRA, but the City Council had to give the final approval to recommendations.
City Attorney Joe Langel will be present for discussion and questions.
