Adopt Resolution #16-10-194 Approving an Easement Encroachment Agreement for the Property Located at 6850 Sunwood Drive NW: Case of Anderson-Dahlen

In reviewing revised plans for the Anderson-Dahlen building expansion, located at 6850 Sunwood Drive NW (the "Subject Property"), it was determined that an Easement Encroachment Agreement (the "Agreement") would be necessary.  The need for the Agreement is to address portions of a public storm sewer line that will be or already is underneath pavement.

Notification is not required when considering an Encroachment Agreement.

There are two public storm sewer lines that traverse portions of the Subject Property.  One takes drainage from Sunwood Drive to the adjacent regional pond.  The second is an overflow outlet from the regional pond.  Both lines either are or will be covered with pavement and curb/gutter.  Should maintenance ever be necessary on this infrastructure, it will require the disruption of the parking lot and maneuvering space.  The Agreement simply solidifies that the City retains its right to maintain this infrastructure and any impacts to the site improvements would be the Subject Property owner's responsibility to repair. 

The request has been reviewed by the City's Engineering Division and they find this approach to be acceptable.

All costs associated with this request are the Applicant's responsibility.

Staff recommends adopting Resolution #16-10-194 approving an Encroachment Agreement for existing and new pavement and curb/gutter over existing public storm sewer lines on the Subject Property.
