Adopt Resolution #16-10-208 Approving Receipt of Sidewalk Easement

The City recently approved the plat known as 'Station' constructed by D.R. Horton. A contingency of the approval was to secure sidewalk easement on any portion of the public sidewalk system that encumbered private property. There is approximately two (2) feet of sidewalk of the six (6) foot wide sidewalk along private property.

D.R. Horton is responsible for constructing the sidewalk. The easement identifies the City as being owner of the sidewalk and responsible for the ongoing maintenance, as is typical with public sidewalks.

Failure to accept the easement would require the redesign of the sidewalk. The City specifically requested, and requires through zoning code, a six (6) foot wide sidewalk for maintenance purposes. The City's maintenance equipment requires this width. 
 

The costs of processing the easement are the responsibility of the Developer.

Staff recommends authorizing the Mayor and City Administrator to execute the easement document accepting the pedestrian and bicycle trail easement on behalf of the City.

Motion to adopt Resolution #16-10-208 accepting the granting of a trail easement to the City.
