Adopt Resolution #17-01-023 Authorizing Sale of City Owned Land: Case of Life Style Properties (Bill Gleason)

Purpose/Background:

PURPOSE
This project (i.e. this land transaction) has been reviewed by the Council a number of times over the past year.  The City has an active purchase agreement in place today for this project.  This land transaction is near the finish line.

Note:  Staff considers this case to be purely administrative/ house-keeping.  We need to make sure we have proper documentation/ final form agreements, ready-to-go, to allow us to close on the sale of this property.  The Anoka County Recorders' Office prefers to have a resolution adopted by the City Council to accompany land sale transactions.  The purpose of this case is to adopt a resolution authorizing this land transaction (for the Anoka County Recorders' Office).



BACKGROUND
The City entered into a purchase agreement for the sale of roughly 3-acres of city owned land to Lifestyle Construction (Bill Gleason) on May 31, 2016 for what is commonly referred to as the "U-shaped" residential parcel located in The COR.  This agreement was set to close by September 26, 2016 (10 days after the September 16 inspection period deadline).  The PA was approved for an extension to close (via two amendments).  The agreement is now set to close by March 16, 2017.

Project Update
Mr. Gleason (the developer) has run into a handful of challenges in site design (which, were expected due to the characteristics of this site).  As a result, he has taken longer to complete the entitlement process than originally expected (i.e. City platting process).  He is still proposing a 12-unit, rambler style, detached, single family, association-type product.  Staff recently met with Mr. Gleason, and his project engineer. 

It appears the project is moving forward.  Sketch plan came forward in November--and was given the go ahead by the Planning Commission and City Council.  Preliminary Plat was reviewed by the Planning Commission on 01/05.  The Council will likely review Preliminary/ Final Plat in February.  Staff is currently in communication with the buyer, his lender, and the title company to arrange a closing time (assumed late February).

Observations/Alternatives:

The purchase agreement with Bill Gleason also called for a "Right-of-Re-Entry" agreement to be recorded at closing.  Attached to this case is the proposed agreement.  Staff is not asking for formal review/ approval of this document by the Council.  We received direction from the Council on this agreement when the formal Purchase Agreement was approved.  However, we are attaching this agreement as an update, and to provide an opportunity to provide comment (objection) if desired.  The attached resolution also refers back to the Right-of-Re-Entry Agreement.
