Title:

Approve Amendments to Curbside Recycling Contract for 2011-2012
 

Background:

On June 22, 2010, the Finance Committee recommended that the City Council extend the curbside recycling contract with ACE Solid Waste, Inc. for two (2) years through December 31, 2012. The City Council ratified that recommendation at its July 13, 2010 City Council meeting. City Staff and ACE Solid Waste have reviewed the terms of the curbside recycling contract have identified several mutually agreed upon contract amendments.
 

Notification:

None required.

Observations:

The bulk of the terms of the recycling contract for 2011-2012 remain the same as the current contract. However, there are a few amendments that have been mutually agreed upon by Staff and ACE Solid Waste, Inc., including adding a new acceptable material, requiring quarterly meetings with ACE Solid Waste, Inc. and eliminating the requirement of a performance bond. Following is a more detailed summary of the proposed amendments to the curbside recycling contract for 2011-2012:
  • Acceptable recyclable materials has been expanded to include aseptic (paper) cartons, which for the purposes of this contract are defined as juice, milk, soup and broth cartons.
  • Quarterly meetings with City Staff and ACE Solid Waste, Inc. to discuss outreach and educational material to promote recycling, target specific recyclable materials, and identify problem materials that are not acceptable.
  • Elimination of the required $25,000.00 Performance Bond.
ACE Solid Waste, Inc. requested that the City consider eliminating the performance bond requirement based on their long history of service and position in the community. ACE has been providing curbside recycling services for Ramsey residents for over ten (10) years now and has a stellar track record in performing this service. Furthermore, per Section 13 (Termination) of the contract, the City has the right to terminate the contract if, in the City's opinion, there has been a breach of contract by the Contractor. Considering ACE's past performance in providing recycling services for the City and after consulting with the City Attorney, Staff believes that the performance bond requirement is not necessary.
 

Recommendation:

City Staff recommends approving the proposed contract amendments for the 2011-2012 curbside recycling contract with ACE Solid Waste, Inc.
 

Council Action:

Motion to approve the amendments to the 2011-2012 curbside recycling contract.

Funding:

Each household covered by the curbside recycling contract (single family homes and town homes) is charged $2.95 per month for recycling. This is collected quarterly through the City's utility billing.
