Title
Adiopt Resolution #17-07-171 Approving an Encroachment Agreement for a Deck to be Partially Located within a Drainage and Utility Easement at 7042 167th Crossing NW; Case of Holly and Cory Steinbach
Purpose/Background:
The City recently received a Building Permit Application for a deck to be constructed at 7042 167th Crossing NW (the "Subject Property"). There is only about five (5) feet between the rear wall of the home and a drainage and utility easement (the "Easement"). Based on the proximity of the home to the Easement, there are not really any viable alternatives for a deck that would not result in an encroachment.
Notification:
Notification is not required when considering an Encroachment Agreement.
Observations/Alternatives:
The proposed deck is twelve (12) feet in depth and twenty (20) feet wide, with a four (4) foot wide stairway down to the ground. While a portion of the deck and stairway encroach into the Easement, it would not have any impact on drainage and there are no public utilities such as storm sewer, sanitary sewer, or municipal water infastructure within the Easement either. The Engineering Department has reviewed this request and has no objection to the Encroachment Agreement.
Funding Source:
All costs associated with this request are the Applicant's responsibility.
Recommendation:
Staff recommends approving the Encroachment Agreement to allow a deck to be partially located within the Easement on the Subject Property.
Action:
Motion to adopt Resolution #17-07-171 approving an Encroachment Agreement between the City and Property Owner for a deck to partially encroach into the Easement on the Subject Property.
