Title

Adopt Resolution #17-10-246 Accepting Pedestrian and Bicycle Trail Easement on a portion of Lot 5, Block 2, Estates of Silver Oaks 2nd Addition (Project #17-119); Case of Royal Oaks Realty, Inc.

Purpose/Background:

The purpose of this file is to review the Trail Easement, prepared by E.G. Rud & Sons, Inc. for Estates of Silver Oaks 2nd Addition.  The subdivision would create eight (8) new single family residential lots and it is located on Lithium Street NW, PID #14-32-25-12-0011 and Outlot A Estates of Silver Oaks (together, the "Subject Property"). The City Council Approved the Final Plat and Development Agreement and Adopted Ordinance #17-09 on September 12, 2017. The resolution was approved contingent on the Developer granting a Pedestrian and Bicycle Trail Easement on the west part of Lot 5, Block 2 adjacent to Trunk Highway 47. 

The Developer has provided a trail easement in accordance with the direction from City Council.  The proposed trail easement has a width of fifteen (15) feet and spans the length of the western lot line of Lot 5, Block 2 of Estates of Silver Oaks 2nd Addition.

Notification:

Notification is not required.

Funding Source:

All costs associated with processing the Application are the responsibility of the Applicant. There are no City funds proposed to be utilized for the construction of this project.

Recommendation:

It is staff's recommendation to Adopt Resolution #17-10-246 accepting the proposed Pedestrian and Bicycle Trail Easement.

Action:

Motion to Adopt Resolution #17-10-246 Accepting a Pedestrian and Bicycle Trail Easement across a portion of Lot 5, Block 2, Estates of Silver Oaks 2nd Addition.
