Adopt Resolution #18-013 Rescinding Award of Contract for Improvement Project #17-13, Potassium Street Cul-De-Sac Improvements
Purpose/Background:
Purpose:
The purpose of this case is to adopt Resolution #18-013 rescinding the Award of Contract for Improvement Project #17-13, Potassium Street Cul-De-Sac Improvements.
Background:
The segment of Potassium Street north of old Nowthen Boulevard is a gravel road with no outlet which the City has maintained for decades, including the turn-around area on 15641 Potassium Street.
This property was recently sold and the new owners posted “No Trespassing” signs on the south edge of their property, contending the public has no right to use their property to turn around on. These signs caused Ace Solid Waste to inform its customers along Potassium Street that they would no longer serve their properties since they could not safely turn their trucks around at the north end of Potassium Street.
Following numerous meetings and discussions with the new property owners, they offered to pay a maximum of $8,050 of the cost to construct a temporary cul-de-sac contingent on several factors, including that the cul-de-sac would not be located on their property, and that the cul-de-sac could be constructed by December 31, 2017.
During this process, Staff solicited quotes from local contractors on three separate occasions. Based on the last request for quotes, Staff received a single quote from Dave Perkins Contracting, Inc. in the amount of $34,877. On October 24, 2017, the City Council accepted the quote and awarded a contract for construction to Dave Perkins Contracting in the amount of $34,877.

Before construction could begin, easements needed to be acquired from two property owners. Staff met with the property owners to discuss easement acquisitions and during these discussions the two property owners said they would prefer to wait to see if the proposed Shade Tree Cottages plat would allow Potassium Street to connect to the stub street to the north, thereby removing the need to construct the temporary cul-de-sac.
In December, Public Works Staff constructed a temporary T-style turn-around west of Potassium Street near the north end using some of the crushed concrete and bituminous stockpiled on the future Public Works site. This work was done to provide a place for Ace Solid Waste’s trucks, as well as other large vehicles, to turn around in. Once the temporary turn-around was constructed, Ace sent a truck out to test it and found it to be acceptable so no interruptions in trash service should occur moving forward.
Staff since contacted Dave Perkins Contracting to discuss the fact that construction of the temporary cul-de-sac is no longer needed this fall/winter. They said they understood the situation and would not contest the City rescinding their Award of Contract, as long as the City again offers them a chance to provide a quote on this work if needed in the future. Staff assured them they would be contacted if this project were to move forward in the future.
