Title:

Adopt Ordinance #19-01 Rezoning the Property at 6316 Riverdale Drive NW from R-1 Residential (MUSA) to E-1 Employment

Purpose/Background:

This case has been reviewed multiple times by the Planning Commission as well as City Council.  The Planning Commission has already approved a variance related to setbacks for outdoor storage on the property located at 6316 Riverdale Drive NW (the "Subject Property"), and on January 8, 2019, the City Council approved a Conditional Use Permit for outdoor storage as the principal and introduced Ordinance #19-01 to rezone the Subject Property from R-1 Residential (MUSA) to E-1 Employment.



 

Notification:

Staff attempted to notify all property owners within 350 feet of the Subject Property of the requested Variance and Conditional Use Permit via standard U.S. mail and published the Notice of Public Hearing in the Anoka County UnionHerald. This same process was previously utilized to notify all property owners within 350 feet of the Subject Property of the requested Zoning Amendment.

Observations/Alternatives:

As noted, on January 8, 2019, the City Council introduced Ordinance #19-01 to rezone the Subject Property from R-1 Residential (MUSA) to  E-1 Employment.  There have been multiple public hearings regarding the proposed use of the Subject Property, including the rezoning, with no written or verbal comments received.  Per the City Charter, the Ordinance is now eligible for adoption.

Alternatives

Alternative 1: Motion to adopt Ordinance #19-01 rezoning the Subject Property from R-1 Residential (MUSA) to E-1 Employment.  The City Council has already approved a Conditional Use Permit for outdoor storage as the principal use of the Subject Property (contingent upon adoption of this ordinance) and the Planning Commission has also granted a various for a reduced setback for the outdoor storage from residential properties.  This is a transitional parcel between the two zoning districts and does not appear to be a desirable location for a residential home.  Staff supports this alternative.

Alternative 2: Do not adopt Ordinance #19-01.  This would leave the zoning of the Subject Property as R-1 Residential (MUSA) rendering the approved Variance and Conditional Use Permit invalid.  The use of the Subject Property for outdoor storage would need to cease as it does not comply with the standards of the R-1 Residential (MUSA) District.  Staff does not support this alternative.

Funding Source:

All costs associated with this request are the responsibility of the Applicant.

Recommendation:

The Planning Commission recommends adopting Ordinance #19-01 rezoning the Subject Property from R-1 Residential (MUSA) to E-1 Employment.

Action:

Motion to waive the City Charter requirement that the Ordinance be read aloud and adopt Ordinance #19-01 rezoning the Subject Property from R-1 Residential (MUSA) to E-1 Employment.
