Title:

Continued Discussion on Administration and Enforcement of City Code Violations

Purpose/Background:

The purpose of this case is to focus on two topics based on recent policy discussion by the City Council.
  1. Definition of Complaint-Based
  2. Definition of Proactive Enforcement in Key Corridors

In framing this conversation, our Mission Statement, Vision Statement, and Key Goals are included below, as this is an important policy discussion.

Complaint-Based Enforcement

Historically, Staff has waited for a formal complaint from a resident, unless the violation affected public health or safety or was required enforcement under State Statutes/Rules.

Based on discussion by the City Council on January 8, Staff believes that the City Council's intent is to allow Staff to follow up on cases if a violation is observed in travels pertaining to their ordinary job duties. Complaint-Based does not include proactive sweeps of area where the primary intent is to seek violations.

The City Council is asked to confirm this direction.

Proactive Enforcement in Key Corridors

This policy question might be answered by clarifying the above definition. Through various planning processes, Staff has been directed to be more proactive in enforcement of nuisance and blight along key corridors, especially Highway 10 and Highway 47. Staff desires clarification on the scope of this direction. Below is Staff's attempt to clarify this policy direction.

Staff will not proactively seek violations on key corridors, however will follow up on violations as observed through travels related to normal course of business. These are heavily travelled corridors, which naturally lends itself to more natural observations. Staff will focus on the following key topics.
  • Long Grass
  • Outside Storage
  • Inoperable Vehicles
  • Parking on Unapproved Surface
  • Parking in Rights of Way/Boulevards
  • Unless the violation obstructs public safety (sight triangles, trails, etc.), Staff will postpone any enforcement related to signs in commercial districts until a broader policy discussion about appropriate standards can be discussed.

The City Council is asked to confirm this direction.

Following this Work Session topic, Staff will forward an updated resolution to a future City Council Meeting to formalize direction.
