Adopt Resolution #19-053 Accepting Permanent Utility Easement on Lot 1, Block 1, LAZYDAYS Addition

Purpose/Background:

Purpose:
The purpose of this case is to adopt Resolution #19-053 accepting a permanent utility easement on Lot 1, Block 1, LAZYDAYS Addition per the executed Utility Easement Agreement.

Background:
A condition of Plat approval for the Lot 1, Block 1, LAZYDAYS Addition property was that their new maintenance facility connect to City sewer and water since the property is located within the City’s Metropolitan Urban Service Area (MUSA).  The maintenance facility is under construction and will include 20 service bays, a waiting area, a parts warehouse, a receiving dock, and office space for approximately 30 staff including service managers and technicians, warehouse staff, and customer service representatives.
 
City Improvement Project #18-14 proposes to extend 18-inch trunk sanitary sewer and 12-inch trunk watermain from the southwest corner of old Armstrong Boulevard and Riverdale Drive along the south side of Riverdale Drive to serve the new maintenance facility.  These improvements have sufficient capacity to serve all existing and future development in the area south of Highway 10 and west of Armstrong Boulevard, which is also located within the City’s MUSA.
 
While Improvement Project #18-14 was being bid, it was discovered that gas, electric and telecommunications lines were previously installed in the same alignment as our proposed trunk utilities.  Since this project is proposed to be completed during winter, impacts to private utilities are problematic as the ground surrounding the private utilities will be frozen making them impossible to relocate without first thawing the ground around them, which would increase the construction schedule and construction costs.  The City’s trunk utilities were therefore moved south of the private utilities, which will require an additional 10-foot of permanent utility easement along the Lazydays RV site to construct and maintain the trunk utilities in perpetuity.
 
Attached is an executed utility easement agreement dedicating a 10-foot wide strip of permanent utility easement along the Lot 1, Block 1, LAZYDAYS Addition property.  The property owner has willingly dedicated this easement via the attached utility easement agreement.  Exhibit B of the attached easement agreement includes a legal description for the permanent utility easement and depicts it graphically.

Notifications are not required for this action.

Observations/Alternatives:

Observations:
Accepting the 10-foot wide permanent utility easement along Lazydays RV’s site per the attached easement agreement is necessary to allow the trunk utilities to be adequately constructed with City Improvement Project #18-14, and to be properly maintained in perpetuity.  This action must be complete before bids are accepted and a construction contract awarded for City Improvement Project #18-14 as included on the regular agenda for this evening’s Council meeting.
 
Alternatives:
Alternative #1 – Motion to adopt Resolution #19-053 accepting a permanent utility easement on Lot 1, Block 1, LAZYDAYS Addition per the executed Utility Easement Agreement.

Alternative #2 – Motion to deny adoption of Resolution #19-053 at this time.

Funding Source:

Accepting the executed utility easement agreement will not require City funding.  The property owner has willingly dedicated the permanent utility easement via the executed utility easement agreement attached to this case.  The easement agreement was prepared by Staff and was reviewed and approved by the City Attorney.

Recommendation:

Staff recommends alternative #1.

Action:

Motion to adopt Resolution #19-053 accepting a permanent utility easement on Lot 1, Block 1, LAZYDAYS Addition per the executed Utility Easement Agreement.
