Adopt Resolution #19-059 Authorizing Final Payment to Pearson Brothers, Inc. for Improvement Project 18-04, 2018 Crack Seal and Seal Coat Program.

Issuing final payment will be contingent on receipt of the following items from Pearson Brothers, Inc.:

1. IC 134 (Contractor’s Withholding Affidavit showing compliance with the provisions of Minnesota Statute 290.92 requiring withholding state income tax)
2. Waiver of Mechanic’s Lien Rights (Affidavits that all claims against Pearson Brothers, Inc. by reasons of the contract have been fully paid or satisfactorily secured)
3. Consent of Surety to Final Payment (Certification from the contractor’s surety)

Following receipt of these items, final payment will be issued.

The Senior Engineering Technician has inspected the completed work and recommends final payment to Pearson Brothers, Inc. for Improvement Project 18-04; Crack Seal and Seal Coat Program in the amount of $24,058.76.

Final construction costs are $21,197.65 (4.8%) greater than the awarded bid with Change Order #1 included.  This cost increase is attributable to additional crack seal work that was required on several street segments due to significantly greater amounts of pavement cracking than was estimated during plan preparation. To help prevent similar over-runs on future crack seal projects, Staff will incorporate additional field reviews of street segments with PASER ratings less than 8 to help ensure that estimated crack seal quantities better reflect actual field conditions.
