Title:
Adopt Resolution #19-071 Approving Preliminary Plat Approval Extension for Riverstone and Approving Final Plat for Riverstone 3rd Addition; Case of Capstone Homes (Project #19-103)
Purpose/Background:
The purpose of this case is to consider the proposed Final Plat for Riverstone 3rd Addition which consists of 35 single family lots as well as consider extending the approved Preliminary Plat for Riverstone by a period of one year. Preliminary Plats can also be considered 'Master Plans' for an overall neighborhood. Construction is approved for individual phases of the Preliminary Plat by Final Plat Approval. Please note that Preliminary Plat approval is the most significant approval of a project, as it gives entitlement to the general layout of a project. Final Plat is simply construction documents and recording documents.
In this case, the Preliminary Plat has already been approved. Preliminary Plat Approvals are valid for a period of one year per Minnesota Statutes Chapter 462.358 (unless otherwise approved or extended by municipality). This Preliminary Plat has already been extended once and is common in a multi-phase development. The Developer is still working with the adjacent Property Owner on a utility extension through this project to the west. The current phase is is not impacted by this discussion. Both parties report positive discussions on this matter.

Staff has attempted to notify all Property Owners within 700 feet of the Subject Property via Standard US Mail of the Final Plat Review. A public hearing is not required for the Final Plat.

All costs associated with processing the Application are the responsibility of the Applicant/Developer.
Recommendation:
The Planning Commission recommends approval of the project.
Action:
Motion to adopt Resolution #19-071 approving the Final Plat for Riverstone 3rd Addition and extending the Preliminary Plat by one year and direct Staff to prepare a development agreement for Riverstone 3rd Addition for future consideration by the City Council.
