Title:
Adopt Resolution #19-151 Approving the Final Plat and Development Agreement for Rivenwick Village 3rd Addition (Project #19-102) Case of Paxmar
Purpose/Background:
The purpose of this case is to consider the Final Plat request for Rivenwick Village 3rd Addition. The requested Final Plat would subdivide approximately 2.14 acres from the current parcel consisting of approximately 9.34 Acres. The purpose of the requested Final Plat is to create a parcel for an assisted living facility known as Suite Living.
Notification:
For the June 6 Planning Commission which included consideration of an updated sketch plan that involved the requested final plat, Staff attempted to notify all Property Owners within 700 feet of the Subject Property, as listed in the Anoka County records, via Standard US Mail of the requested sketch plan review. The sketch plan review notice for the June 6 Planning Commission was also published in the Anoka Union Herald.

Observations/Alternatives:
The proposed Final Plat adheres to all bulk standards of the Mixed Use Planned Unit Development (MU-PUD) district. The property is being platted in order to be sold for an assisted living housing project known as Suite Living which is currently under review by the City.
Alternatives
Alternative 1: Adopt Resolution #19-151 approving the Final Plat and Development Agreement for Rivenwick 3rd Addition contingent upon compliance with staff comments. Staff supports this alternative.
Alternative 2: Recommend denial of Resolution #19-151 approving the Final Plat and Development Agreement for Rivenwick 3rd Addition. If the City Council elects to deny the resolution it should provide specific findings for denial. Staff does not support this alternative.

Recommendation:
The Planning Commission recommended approval of the associated sketch plan incorporating staff's recommendation that the future phase shown to the north include two (2) commercial pad's rather than one (1) commercial pad and one (1) multifamily development. The Planning Commission recommended approval of Phase 1 (the Final Plat) contingent upon compliance with staff review.
