Title:
PUBLIC HEARING: Introduce Ordinance #19-09 Vacating Right-of-Way for River Walk Village; Case of Don Kveton/Village Bank (Project 18-163)
Purpose/Background:
The purpose of this case is to review the Preliminary Plat Application submitted by Village Bank (the "Applicant") for River Walk Village, at the property generally known as 6080 Highway 10 NW (the "Subject Property") for a 14 lot residential subdivision. The Applicant has proposed 50-foot wide, R-2 Detached Villa lots in the southeastern portion of the City, south of Highway 10 and north of the Mississippi River, just west of King's Island. The City Council approved the preliminary plat on June 25, 2019. Items that have been approved related to this case include: rezoning, comprehensive plan amendment, approval of preliminary plat, variance(s).

Notification:
For the easement vacation, a Public Hearing Notice was mailed to Property Owners within 700 feet of the Subject Property. Staff used the Anoka County Property Records Database to obtain Owner Information. The Public Hearing Notice was also published in the Anoka County UnionHerald.
Previously, notifications of the Preliminary Plat were sent via Standard US Mail to Property Owners within 700 feet of the Subject Property, as reflected by Anoka County Property Records.

Summary
River Walk Village was granted preliminary plat approval on June 25, 2019 by the Ramsey City Council for 14 medium-density residential lots. The lots are 50 feet wide and generally meet all of the requirements of the R-2 Residential District. Tonight will focus on introducing the necessary ordinance to vacate right of way no longer needed for the project. Future cases will consider approval of the Final Plat and Grant Agreement for contaminated soils cleanup.
This project also includes the vacation of existing easement that was provided to then Ramsey Township for access to King's Island in Anoka which had originally been platted for single-family homes. The right of way for Rivlyn Avenue currently extends off the existing cul-de-sac and heads south to King's Island and the Mississippi River Trail. The plat for River Walk Village proposes that Rivlyn Avenue will be continued east-west through the site and cul-de-sac on the east side of the Subject Property. The Mississippi River Trail will be encumbered by an Outlot, to be deeded to the City to maintain the trail.

All costs associated with processing the Application are the responsibility of the Applicant.
The Developer has received a grant from the Livable Communities Action - Tax Base Revitalization Account (TBRA) Grant from the Metropolitan Council. This grant requires a local match, which will be discussed in a future case.

Recommendation:
Staff Recommends Approval of Ordinance #19-09 Vacating Right-of-Way for River Walk Village. This is the first of two readings of the ordinance (introduction and adoption).
