Title

Adopt Resolution #19-193 Approving Updated Development Agreement for Anderson Dahlen (Project #19-109); Case of Knoll Properties (Anderson Dahlen)

Purpose/Background:

The purpose of this case is to review an updated development agreement between the City of Ramsey and Anderson Dahlen. City Staff has been actively working with Anderson Dahlen on language within the City's standard development agreement and has provided the updated development agreement for consideration by the City Council.

The City recently approved a proposed Plat and Site Plan for a new manufacturing facility at the southeast corner of Jaspar Street and 143rd Ave (the "Subject Property"). The Subject Property is owned by the City and the Applicant has an active purchase agreement with the City. The Subject Property would be about nine (9) acres in size. The remainder of the property would be retained by the City for a future Public Works Campus.

Notification is not required and was not completed for this City Council Review

Observations/Alternatives:

The development agreement is being put in place to cover private site improvements and does not include any public improvements.  The development agreement has been updated to reflect that information with additional language added related to timing of rights of re-entry and timing of construction.

Alternative 1: Adopt Resolution #19-193 Approving Updated Development Agreement for Anderson Dahlen. The development agreement is subject to review and approval by the City Attorney. Staff does not anticipate issues with the proposed revisions from the city's standard development agreement.  Staff is supportive of this alternative.

Alternative 2: Adopt Resolution #19-193 Approving Updated Development Agreement for Anderson Dahlen with revisions as proposed by City Council.  Staff is not opposed to this option however we believe to have ironed out the necessary details with the Applicant with review by legal staff.

Alternative 3: Do not adopt Resolution #19-193 approving an updated development agreement for Anderson Dahlen.  Execution of a development agreement is the next step in the development process.

Funding Source:

All costs associated with this request are the Applicant's responsibility.

Recommendation:

Staff recommends adoption of Resolution #19-193 Approving the updated Development Agreement for Anderson Dahlen; contingent upon compliance with approval of final construction plans by the City Engineer and review of the development agreement by the City Attorney.

Action:

Motion to adopt Resolution #19-193 Approving Updated Development Agreement for Knoll Properties (Anderson Dahlen).
