Consider Request for City to Acquire Driveway Between Blue Velvet Car Wash and Riversbend Bar and Grill

Purpose:

Provide recommendation / direction concerning request by Owner of Blue Velvet Car Wash to purchase driveway between Blue Velvet Car Wash and Riversbend Bar and Grill.

Background:
City staff was contacted by the owner of Blue Velvet Car Wash on December 12, 2019.  The owner has requested that the City purchase and/or maintain the driveway between the two businesses.  The owner pays taxes on the half of the driveway and has to maintain the driveway at his own cost.  The owner claims the driveway is in rough condition with large potholes and that it is a well traveled "Road" that the public, police and fire use on a regular basis.  The owner has indicated that he is considering stopping the maintenance on the road and potentially putting up a chain or cones to prevent travel through to Xkimo Street.

Staff has reviewed the Rivers Bend Plaza Plat and it appears this is not a dedicated street and the the driveway is privately owned.

Staff was contacted on December 12, 2019.  A response should be provided to the owner when a recommendation / direction has been determined. 

The City should consider the following options:

1) Communicate to owner that the City has no interest in purchasing driveway.
2) Begin negotiations to purchase parcel, and dedicate roadway.
3) Begin negotiation to obtain an easement and to maintain driveway.
4) Something else.

Staff recommendation would be to not purchase/maintain Blue Velvet Lane at this time.  As the committee is aware, a long term road maintenance funding strategy has yet be be formalized and the list road maintenance needs is quite long at this time.

Motion to committee is to decline the offer to purchase/maintain Blue Velvet Lane and have it remain a private road.
