Title:
Adopt Resolution #20-091 Accepting Drainage and Utility Easement Related to Riverstone 4th Addition; Case of Riverstone, LLC
Purpose/Background:
The purpose of this case is to review a request from Capstone Homes dba Riverstone, LLC (the "Applicant") to grant the City a permanent 60 foot drainage and utility easement over parts of Riverstone 4th Addition (the "Subject Property"). The easement is required for utilities extension to the property to the west (currently under contract for the Preserve at Northfork residential subdivision) that will be recorded after the Plat.

Observations/Alternatives:
Summary
The proposed easement is a standard 60 foot drainage and utility easement that meets City standards. During previous discussions with City Council, the Applicant was directed to extend (stub) utilities to the property directly adjacent to the west. The proposed drainage and utility easement would allow the utilities to be put in and provided to the property to the west. The Applicant has worked with the adjacent property owner per request of the City Council to provide the utility connection.
Drainage and Utility Easements
The drainage and utility easements are required over areas where City utilities are put in to allow the City maintenance of the utilities. The easement in question is required for the health and safety of the community, and Staff is supportive of granting the permanent easement on behalf of the City. Without the granting of the permanent easement, utilities cannot be connected to the adjacent property. The City Council must accept these easements by Resolution, and this is a standard process.

Funding Source:
