Title
Adopt Resolution #20-131 Approving an Easement Encroachment Agreement with Delta ModTech for Installation and Maintenance of Signage in a Drainage and Utility Easement at 8445 Bunker Lake Boulevard NW (Project No. 19-108); Case of Delta ModTech
Purpose/Background:
Delta Modtech (the "Applicant") received Final Plat and Site Plan approval in 2019 for construction of a new facility on Lot 1 Block 1 Amsterdam Extension (the "Subject Property"). The facility is nearing completion and the Applicant is preparing to install a new monument sign and directional signage on the Subject Property along Bunker Lake Boulevard. There are three (3) entrances to the Subject Property, with the area around the eastern two entrances having larger drainage and utility easements (the "Easements") for stormwater maintenance purposes.
Due to the location and size of the Easements on the Subject Property, there is no reasonable area to locate the signage without encroaching into the Easements. Thus, the Applicant has requested an Easement Encroachment Agreement to allow two (2) signs, one monument style sign and one directional sign, to be installed and maintained within the Easements adjacent to the two eastern most entrances to the Subject Property.

Notification:
Notification is not required.
Observations/Alternatives:
The Applicant is proposing to construct and maintain one (1) monument sign at the eastern most entrance, and two (2) directional signs, one each at the other two entrances (see the attached exhibits showing the proposed sign locations). The western most directional sign would not be within the Easements and thus, the Easement Encroachment Agreement is only for the monument sign and one directional sign. All proposed signage complies with the standards outlined in City Code Chapter 117 (Zoning and Subdivisions), Article II (Zoning), Division 8 (Signs).
Funding Source:
This request is being handled as part of Staff's regular duties. However, if the Easement Encroachment Agreement is approved, the Applicant will be responsible for recording the document against the Subject Property, including the applicable recording fee.
Recommendation:
City Staff is recommending approval of the Easement Encroachment Agreement, contingent upon review and approval by the City Attorney, and by the City Engineer as to the actual location of the signs.
Action:
Motion to approve Resolution #20-131 approving an Easement Encroachment Agreement for Delta ModTech, contingent upon review and approval by the City Engineer as to the actual location of the signs.
