Title:
Adopt Resolution #21-095 Approving Easement Encroachment Agreement for Certain Lots in the Preserve at Northfork
Purpose/Background:
The purpose of this case is to review an easement encroachment request from BK Land Development, LLC (the "Applicant"). The Subject Properties for which an easement encroachment agreement is requested are for Lots 5 - 10, Block 4, and Lot 6, Block 3, Preserve at Northfork 1st Addition, Anoka County, Minnesota. The request is to allow a one foot overhang into the 5 foot side yard drainage and utility easement. This agreement allows them to overhang into this area with the understanding that the easement can still function with the one foot overhang into the side yard drainage and utility easement. In future additions, side yard easements will be reduced to 4 feet to prevent this issue.

All costs with processing this request are the responsibility of the Applicant.
Recommendation:
Staff recommends approval of this request.

Motion to adopt Resolution #21-095 approving drainage and utility easement encroachments in the Preserve at Northfork subdivision.
